  • Services are provided on an "as is" and "as available" basis, subject to the terms of your Service Order and our Terms and Conditions.
  • No managed service can eliminate all risk. IT environments are inherently complex, and outcomes are influenced by factors including client-side configurations, third-party dependencies, network conditions, and user behavior — many of which are outside SSE's control.
  • Service capabilities and limitations are defined in your Service Order. General marketing descriptions on the Website are illustrative and do not override specific contractual terms.
  • We continuously improve our Services, which may result in changes to features, interfaces, or supported platforms. We provide advance notice of material changes as outlined in our Terms and Conditions.

Section 4

Service Level Commitments

Our uptime commitments and support response times are defined in our Terms and Conditions (Section 4: Service Level Agreement). These commitments are subject to the following clarifications:

  • Uptime percentages are calculated on a monthly basis and exclude scheduled maintenance, client-caused disruptions, force majeure events, and third-party failures beyond SSE's control.
  • Response time commitments refer to the initial acknowledgment of an issue, not the time to full resolution. Resolution times depend on the complexity and severity of each incident.
  • Service credits issued under the SLA constitute the client's sole and exclusive remedy for downtime and do not represent an admission of fault or liability.
  • Historical uptime performance is not a guarantee of future performance.

No Professional Advice

Nothing on the Website or in any communication from SSE shall be construed as professional advice in any specific domain, including but not limited to:

  • Legal Advice: Content regarding compliance frameworks (GDPR, HIPAA, PCI-DSS, etc.) is provided for general awareness only. You should consult qualified legal counsel for advice specific to your regulatory obligations.

  • Non-Infringement: While we take reasonable precautions, we do not warrant that the use of our Services will not infringe upon any third-party intellectual property rights.
  • Accuracy and Completeness: We do not warrant that information, content, recommendations, or technical specifications provided through the Website or Services are error-free, accurate, or complete at all times.
  • Uninterrupted Operation: We do not warrant that the Website or Services will be available without interruption or that they will be free from errors, vulnerabilities, viruses, or other harmful components.
  • Results and Performance: We do not warrant specific performance outcomes, data transfer speeds, storage performance metrics, or processing benchmarks, as these are influenced by numerous factors outside our control.

7.1 Exclusion of Consequential Damages

In no event shall SSE, its directors, officers, employees, agents, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, revenue, business, or anticipated savings.
  • Loss of data, whether or not caused by SSE's negligence.
  • Loss of goodwill or business reputation.
  • Cost of procurement of substitute goods or services.
  • Business interruption or downtime costs.
  • Any loss or damage arising from circumstances beyond SSE's reasonable control.

7.2 Aggregate Liability Cap

SSE's total cumulative liability for all claims arising out of or related to the Website, Services, and this Disclaimer — whether in contract, tort (including negligence), strict liability, or otherwise — shall not exceed the total fees actually paid by you to SSE during the twelve (12) months immediately preceding the event that gave rise to the claim.

7.3 Exceptions

Nothing in this Disclaimer shall exclude or limit liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under applicable law.

Data and Backup Responsibility

While SSE provides enterprise-grade backup and storage solutions, it is important to understand the shared responsibility model for data protection:

8.1 Client Responsibility

  • You are solely responsible for the content, integrity, and legality of all data you store, process, or transmit using our Services.
  • You are responsible for maintaining independent backups of critical data. SSE's backup services are designed to supplement — not replace — your own data protection strategy.
  • You should regularly verify the integrity and recoverability of your backups through test restores.
  • You are responsible for implementing appropriate access controls and security measures for your data within our infrastructure.

8.2 SSE Responsibility

  • SSE is responsible for maintaining the infrastructure, security, and availability of the backup and storage platforms as defined in your Service Order and SLA.
  • SSE does not access, inspect, or modify client data except as necessary to provide the Services, respond to support requests, or comply with legal obligations.
  • In the event of data loss caused by a verified failure of SSE's infrastructure (excluding client-side errors, misconfigurations, or force majeure events), SSE's liability is limited to commercially reasonable efforts to restore data from available backups and the service credits defined in the SLA.

Backup Best Practice. SSE recommends following the 3-2-1 backup rule: maintain at least three copies of your data, stored on two different types of media, with one copy stored offsite. Our cloud backup services are designed to serve as a reliable offsite component of this strategy.


Section 9

Third-Party Products and Services

Our Services may incorporate, integrate with, or depend upon third-party software, hardware, platforms, and services, including but not limited to:

  • Virtualization platforms (e.g., VMware, Hyper-V, KVM)
  • Backup software (e.g., Veeam Cloud Connect)
  • Operating systems (e.g., Linux distributions, Microsoft Windows Server)
  • Control panels (e.g., cPanel, Plesk)
  • Payment processors (e.g., Stripe, PayPal)
  • CDN and security providers (e.g., Cloudflare)

SSE disclaims all responsibility for:

  • Defects, vulnerabilities, or limitations in third-party software or services.
  • Changes, discontinuations, or pricing modifications imposed by third-party vendors.
  • Data processing practices of third-party providers (governed by their respective privacy policies).
  • Compatibility issues between third-party products and your specific configurations.

Third-party products and services are governed by their own license agreements, terms of service, and privacy policies. SSE's use or recommendation of any third-party product does not constitute an endorsement, warranty, or guarantee of that product.
